Wahl My First Time Challenge Contest Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

 

BY ENTERING, ENTRANTS AGREE TO THESE OFFICIAL RULES, WHICH CREATE A BINDING CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, SUCH CONTRACT INCLUDES GRANTS OF RIGHTS AND INDEMNITIES TO THE CONTEST ENTITITES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

 

PROMOTION PERIOD: The Wahl My First Time Challenge Contest (“Contest”) begins October 14, 2021 at 12:00:01 AM Central Time (“CT”) and ends November 5, 2021 at 11:59:59 PM CT (the “Promotion Period”). Entries received before or after the Promotion Period are void. Sponsor’s computer is the official clock of the Contest.

 

ELIGIBILITY:  Entrants must be at least 18 years of age or the age of majority in their state of residence, whichever is older, at time of entry and be legal residents of one of the 50 United States or the District of Columbia. This Contest is void where prohibited by law. Employees, officers, and directors of WAHL Clipper Corporation (“Sponsor”) and its parent company, affiliates or subsidiaries, and advertising agencies, promotional agencies, judging organization, and any other individual or company involved in the development, promotion, or execution of the Contest, and members of those employees’ immediate families (spouse and parent, children and siblings, and their respective spouses and children, regardless of where they reside), and persons living in the same household (whether or not related) of such employees are ineligible to enter or win. Sponsor will determine in its sole discretion whether a potential entrant meets the eligibility requirements. By participating, entrant agrees to these Official Rules, and the decisions of the Sponsor and/or its independent judges, which are final and binding in all respects.

 

HOW TO ENTER:  During the Promotion Period, go to Wahl Grooming’s Facebook page (https://facebook.com/wahlgrooming/) or @wahlgrooming on Instagram and click on the “Wahl My First Time Challenge Contest” page tab to access the Contest Application. Follow the directions to enter the Contest. Submit Before and After photos of your at-home haircut (the “Photos”), answer qualifying questions related to your haircut, including your intention for another ‘first-time’ experience (the “Answers”), and enter your contact information (collectively, an “Entry”). All Entries must be received by 11:59:59 PM CT on November 5, 2021 to be considered. You must cut your own hair, and you must do so with electric clippers. Scissors alone are not allowed. Each Entry must comply with the Contest Entry Requirements (defined below) and these Official Rules.

 

Limit one Entry per person. Entries received from any person in excess of the limitation will be void if discovered by Sponsor. Once posted, an Entry cannot be deleted, cancelled, or modified. Multiple, separate Entries may be submitted from different individuals residing in the same household. No forms of entry other than as stated in these Official Rules will be accepted. A Facebook or Instagram account is required to enter via this entry method and can be opened for free at www.facebook.com or www.instagram.com or by downloading the Facebook or Instagram application onto your smart phone from your appropriate app store.

 

Contest Entry Requirements:  In addition to the provisions set forth herein, each Entry must comply with the following guidelines or will be subject to disqualification:

 

• Photos and Answers:
  1. may not have been submitted in any other competition;
  2. may not have been published;
  3. must not be inappropriate, offensive, defamatory, or obscene;
  4. must not infringe upon any third party's rights, including, but not limited to, copyright, patent or trademarks/trade names/logos, or rights of privacy or publicity;

 

• Answers must be the original and sole creation of the entrant, owned solely by the entrant;
• Photos must have been taken since January, 2020 and must be the original and sole creation of the entrant, owned solely by the entrant, or entrant must have received permission from the owner of the rights in the Photos to submit the Photos in this Contest and to grant the rights provided for herein;
• Any Photo or Answer, in the sole opinion of the judges and/or Sponsor, found to contain dangerous, harmful, or objectionable content, or deemed to be inappropriate for publication or to otherwise violate any of the above requirements, will be deemed ineligible;
• Photos and Answers cannot be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, or contain nudity;
• Photos cannot show or promote cruelty, harm, abuse, or exploitation of anyone or anything;
• Photos and Answers cannot promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), promote any activities that may appear unsafe or dangerous, or promote any particular political agenda or message;
• Photos and Answers cannot endorse any form of hate or hate group; or appear to duplicate any other submitted Entry;
• Photos and Answers must be in keeping with the Sponsor’s image, and may not be offensive, nor can they defame, misrepresent, or contain disparaging remarks about Sponsor or its products or other people, products, or companies, as determined by Sponsor and the Contest Judges in their sole discretion;
• Photos and Answers cannot advertise or promote any brand or product of any kind other than Wahl and cannot depict an entrant using scissors or any brand of clippers other than Wahl for a haircut;
• Photos and Answers cannot contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
• Photos and Answers cannot contain copyrighted materials owned by others (including, photographs, sculptures, paintings and other works of art or images published on or in web sites, television, movies or other media), without permission;
• Photos and Answers cannot contain materials embodying the names, likeness, voices, or other indicia identifying any person (other than the entrant), including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
• Photos cannot consist of or contain look-alikes of celebrities or other public or private figures, living or dead;
• Photos and Answers cannot communicate messages or images inconsistent with the positive images and/or goodwill with which Sponsor wishes to associate; and
• Photos cannot violate any law.

 

All Entries will undergo screening for compliance with the guidelines and requirements set forth in these Official Rules. By submitting your Entry, you represent and warrant that the Entry complies with the guidelines set forth herein and agree that your Entry conforms to these Official Rules and that Sponsor, in its sole discretion, may disqualify your Entry for any reason, including if it determines that your Entry fails to conform to these Official Rules in any way or otherwise contains unacceptable content as determined by the Sponsor. BY SUBMITTING AN ENTRY, ENTRANT ACKNOWLEDGES THAT THE ENTRY MAY BE POSTED ON SPONSOR’S WEBSITE, ITS FACEBOOK PAGE AND OTHER SOCIAL MEDIA PAGES, AND/OR ON THE CONTEST PLATFORM, IN SPONSOR’S DISCRETION. Submission of an Entry grants Sponsor and its agents an unlimited, worldwide, perpetual, license and right to publish, use, publicly perform the Entry in any way, in any and all media, without limitation, and without consideration to the entrant. Sponsor reserves the right not to post or, after posting, to remove, an Entry for any reason. The entry information provided is subject to WAHL’s Privacy Policy. To read that Policy, access  www.WahlUSA.com and then click the “Privacy Policy” button. Entries (but not the Photos or Answers) become the property of Sponsor and will not be acknowledged or returned.

 

WINNER SELECTION/JUDGING: On or around the week following the Promotion Period, all eligible Entries will be evaluated and reviewed by a judging panel appointed by the Sponsor and consisting of employees of the Sponsor’s marketing team to select 10 potential finalists (“Finalists”) based on the following judging criteria:

 

• Haircut images (Photos) portray ingenuity and respectable haircutting skill (40%)
• The Answers exhibit home-haircutting enthusiasm, as well as a desire to achieve something else “new” that will have a positive impact on the entrant’s life (60%)

 

If there is a tie for the 10^th Finalist position, the judges will re-judge the tied Entries to break the tie.

 

Sponsor will then attempt to contact Finalists to do short (15-30 minute) phone interviews. If potential Finalist fails to respond within 72 hours of initial notification attempt, is unable or unwilling to participate in the interview, or is not in compliance with these Official Rules (including eligibility requirements), Sponsor may select an alternate Finalist (the non-winning Entry with the next highest score) if time permits. Phone interview responses will be judged on the degree to which the Finalist shows enthusiasm and an intention to use the prize money to achieve the winner’s first-time new experience (“Experience”), and to share the results to be potentially merchandised on the Wahl Grooming social pages. The Finalist interview score (50%) will be combined with the Photos score (20%) and Answers score (30%) to determine winners.

 

The five highest overall scoring Finalists will be deemed potential winners, pending confirmation that they meet the eligibility requirements. If there is a tie for the fifth potential winner position, the score for the “finalist interview” will be the tiebreaker. The Contest winners will be announced on or about November 15, 2021.

 

WINNER NOTIFICATION AND VERIFICATION: Sponsor will attempt to notify the potential winners by email or telephone. Potential winners must respond within 48 hours of initial notification attempt and confirm their  acceptance of the prize. All potential winners must sign and return an Affidavit of Eligibility/Release of Liability Form, Publicity Release (where lawful), Photo/Answer Release, a Federal Form W-9 (with a valid Social Security number) and submit a photocopy of a valid government issued photo ID (either driver’s license or passport) as validation to verify potential winner is the person in the Photos, within 72 hours of the time Sponsor sends form to potential winner. If potential winner fails to respond to initial notification by the deadline set forth above, fails to sign and return required documents or provide identification by the deadlines set forth above, refuses to cooperate with a background check (as set forth below), is disqualified pursuant to the background check, or is not in compliance with these Official Rules (including eligibility requirements), Sponsor may select an alternate winner (the non-winning Entry with the next highest score) if time permits.

 

BACKGROUND CHECKS:  The potential winners must agree to a background check, to complete a background check release, and to provide any information that Sponsor reasonably requests to conduct a background check, including Social Security number, and understand that no further notice is required to be provided to them by Sponsor with respect to such background check, and that Sponsor has the right, but not the obligation to conduct such background check prior to identifying or confirming a potential winner. Factors that may result in disqualification as a winner, in Sponsor’s sole discretion, include, without limitation, negative driver history or record, any drug or alcohol dependency, criminal arrests or convictions, civil law suits alleging misconduct - either settled or still pending, and any other fact or allegation that, in Sponsor’s reasonable discretion, would be inconsistent with the image, messages, and goodwill that Sponsor seeks to convey and be associated with, whether such facts are revealed to Sponsor in connection with a background check or otherwise.

 

PRIZES:  A total of five winners will each receive a prize package consisting of one WAHL Elite Pro Clipper (exact make and model to be determined solely by the Sponsor), and one $2,000 prepaid card to be used for the Experience. The approximate retail value (“ARV”) of the prize package is $2,059.99.

 

Total ARV of all prizes: $10,299.95.

 

Only the stated number of prizes in these Official Rules will be awarded. All other expenses not specified herein are the responsibility of the winners. If an inadequate number of qualified Entries are received to award all of the prizes, Sponsor reserves the right to award fewer than the number of prizes stated above.

 

Winner is responsible for reporting and paying all income, sales or excise taxes that may apply to accepting a prize. The winners will be issued an IRS 1099 form for the value of their prize. No substitution, assignment, redemption for cash, or transfer of any prizes permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value if an offered prize becomes unavailable. Actual value of prizes may vary based on consumer electronic industry fluctuations. Winner will not receive difference between actual value and ARV.

 

Allow 8 to 10 weeks for shipment of all prizes. Sponsor shall not be held responsible for any delays in awarding any prize for any reason outside of its control. All prize details are at Sponsor’s sole discretion. A prize will be delivered only to a verified winner.

 

The Experience must not involve any activity that is dangerous to winner or others, that involves alcohol or drug use, that involves any sort of sexual activity, that involves any activity against public morals, that violates the rights of any third party, that would expose a third party to embarrassment or humiliation, that involves the use of any hair-care products competitive with Wahl, that would place Wahl in a negative light, or that is otherwise deemed unacceptable by Sponsor. The Experience must also be consistent with the Experience described in winner’s Answers (i.e., winner can’t describe one activity and then do another with the prize).

 

GENERAL:  By participating in the Contest, entrants agree to release and to indemnify and hold harmless Sponsor, Facebook, Inc., Instagram, and their parent companies, affiliates, subsidiaries, retailers, franchisees, advertising agencies, promotion agencies, judging organization, and any other individual or company involved in the development, promotion, or execution of the Contest, including Premier Business Solutions, LLC, and all of their respective officers, employees, directors, representatives and agents (individually and collectively “Releasees”) from all liability, losses, claims, action, or proceedings, all injuries and damages of any kind to person(s), including death or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Contest, the Experience, or any Contest-related activities, or violation of intellectual property or personal rights (such as but not limited to, copyright, patent, trade name/trademark, and/or rights of privacy or publicity or portrayal in a false light) due in whole or in part to acceptance, possession, misuse or use of any prize; or participation in this Contest, or participation in any Contest-related activity and from Sponsor’s use of the Photos or Answers as provided for herein. By claiming a prize, each winner agrees to confirm that consent in writing upon request, to Sponsor and those acting pursuant to the authority of Sponsor, the right, in perpetuity, to the use of winner’s name, voice, picture, image, and/or likeness (and notwithstanding anything to the contrary in these Official Rules, winners license the use of their Photos and Answers to Sponsor, which may be altered, changed, modified, edited, used alone, together or with other works, and/or in distorted form, as solely determined by Sponsor) at any time(s) and in all media now known or hereafter discovered, worldwide, including on the Internet and World Wide Web, for advertising, commercial, trade, and promotional purposes without additional compensation unless prohibited by law, and without notice, review or approval. Entrant agrees that submissions are gratuitous, unsolicited and without restriction, and will not place Sponsor under any obligation, and that Sponsor is free to disclose the ideas contained therein on a non-confidential basis to anyone or otherwise use the ideas without restriction and without any additional compensation to entrant. Entrant acknowledges that, by acceptance of the Entry, Sponsor does not waive any rights to use similar or related ideas from any source. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to entrant. By entering, entrant acknowledges that Sponsor has no obligation to use or post any Entry submitted and further agrees entrant will not post or publicly make any disparaging or negative comments about Sponsor or its parent, affiliates, or subsidiaries, or any of their products on any web site or in any other type of media. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process, or operation of the Contest or to be acting in violation of the terms of the applicable social media platform or if such entrant shows a disregard for, or attempts to circumvent, these Official Rules; or if such entrant threatens the integrity of the Contest by posting or otherwise disseminating material about the Contest on Instagram, Facebook, or any other social network that is offensive, vulgar, obscene, or defames anyone or any entity; or if such entrant acts: (i) in a manner the Sponsors determine to be not fair or equitable; (ii) with an intent to annoy, threaten or harass any other entrant, or Sponsors; or (iii) in any other disruptive manner. If a dispute arises regarding compliance with these Official Rules, Sponsor may consider, in its sole discretion, data reasonably available to Sponsor through information technology systems in Sponsor’s control, but Sponsor will not be obligated to consider any data or other information collected from any other source. Any failure by Sponsor to enforce any of these Official Rules will not constitute a waiver of such Official Rules. If there is a conflict between any term of these Official Rules and any marketing or entry materials used in connection with the Contest, the terms of these Official Rules will govern.

 

If, for any reason, Contest is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures, or any other causes that, in the sole opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend Contest. If Sponsor terminates the Contest during the Promotion Period, Sponsor will determine the winners from eligible, non-suspect Entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor, and Sponsor will determine the prize winners by applying the judging criteria set forth above, or as otherwise deemed fair and equitable by Sponsor. If Sponsor terminates, modifies, or suspends the Contest, Sponsor shall post notice at www.WahlUSA.com and on Sponsor’s Facebook and Instagram pages.

 

LIMITATIONS OF LIABILITY:  Releasees are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, illegible, delayed, misdirected, separated, or non-delivered Entries; or for lost, interrupted or unavailable satellite, unavailable network, server, Internet Service Provider, website or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, including typographical, printing, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information with the administration of the Contest, the processing or judging of Entries, the announcement of the prizes, the incorrect uploading of the Photos or in any Contest-related materials. Releasees are not responsible for any incorrect or inaccurate information, whether caused by website users, or by any equipment or programming associated with or used in this Contest, and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of the entry process. Releasees are not responsible for injury or damage to entrant’s or any other person’s computer related to or resulting from participating in this Contest or downloading, printing, or copying materials from or use of social media.

 

DISPUTES:  As a condition of entering, entrants agree (a) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (b) all causes of action arising out of or related to this Contest, or any prize awarded, will be resolved individually, without resort to any form of class action; and (c) all claims, judgments and award will be limited to actual out-of-pocket costs incurred, excluding attorneys' fees and court costs.

 

JURISDICTION/CHOICE OF LAW:  By entering, entrants agree that this Contest will be governed by the laws of the State of Illinois and agree to venue and jurisdiction solely in Whiteside County, Illinois for the resolution of all disputes.
